Please read these Terms carefully. These Seafarer Terms of Use govern your use of the SEAKER Mobile App and Platform as a seafarer or individual user. They should be read together with the SEAKER Privacy Policy and the SEAKER Seafarer Data Sharing Consent Terms (which govern data-sharing consents). These Terms are separate from the SEAKER Terms of Use for Platform Partners, which govern manning agencies, training providers, property hosts, and media publishers.
1. Acceptance of Terms
1.1 By registering for, accessing, downloading, installing, or using the SEAKER Mobile App, website, or any related services (the “Platform” or the “Service”), you (“Seafarer,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.
1.2 These Terms form a binding agreement between you and SEAKER. They incorporate by reference the SEAKER Privacy Policy and the SEAKER Seafarer Data Sharing Consent Terms.
1.3 SEAKER may modify these Terms from time to time by posting an updated version on the Platform or at seaker.ph. Material changes will be brought to your attention. Your continued use of the Platform after an update takes effect signifies acceptance of the revised Terms.
2. Definitions
For purposes of these Terms:
• “Platform” means the SEAKER digital ecosystem (mobile applications, website, software, APIs, and related services).
• “Platform Partners” means manning agencies, training providers, property hosts, and media publishers registered to use the Platform.
• “Content” means any data, text, images, documents, files, or other materials uploaded to or delivered through the Platform.
• “Personal Data” has the meaning given under Republic Act No. 10173 (Data Privacy Act of 2012) and as described in the SEAKER Privacy Policy.
• “Consent Terms” means the SEAKER Seafarer Data Sharing Consent Terms governing data-sharing consents (school visibility, welfare and emergency support, and Manning Agency visibility).
3. Scope of Service; No Agency
3.1 SEAKER is a technology company that connects seafarers with Platform Partners. SEAKER does not itself provide recruitment, manning, employment, training, or accommodation services.
3.2 All transactions, job offers, training enrollments, and accommodation arrangements are solely between you and the Platform Partner. SEAKER is not a party to those transactions and is not responsible for the performance, legality, safety, or quality of services offered by Platform Partners. You use such services at your own risk.
3.3 No joint venture, partnership, employment, or agency relationship exists between you, SEAKER, or any Platform Partner as a result of these Terms or your use of the Platform.
4. Eligibility & Account Registration
4.1 Age requirement — You must be at least eighteen (18) years old and legally able to enter into a binding contract to use the Platform. The Platform is not available to persons under 18.
4.2 Accurate information — You agree to provide true, accurate, current, and complete information, and to keep it updated. SEAKER may rely on your information as accurate. If your information is untrue or incomplete, SEAKER may suspend or terminate your access.
4.3 Account security — You are responsible for keeping your account credentials confidential and for all activity under your account. You must notify SEAKER promptly of any unauthorized use. You may not transfer or assign your account to any other person.
4.4 Authorized access only — You may access the Platform only through authorized means and on a compatible device. SEAKER is not liable if you use an incompatible or unauthorized device.
5. Acceptable Use
5.1 You agree to use the Platform only for lawful purposes and only for its intended purpose. You agree that you will not:
• use the Platform to send or store unlawful, fraudulent, infringing, obscene, threatening, or otherwise objectionable material;
• make false or fraudulent applications, bookings, or enrollments, or cause nuisance or inconvenience;
• contact Platform Partners for purposes unrelated to the Service;
• impair, disrupt, or circumvent the proper operation or security of the Platform or its networks;
• attempt to gain unauthorized access to the Platform or related systems;
• use bots, scrapers, spiders, or other automated means to access, index, or data-mine the Platform;
• impersonate any person or entity or misrepresent your affiliation;
• defraud SEAKER or unfairly enrich yourself through any promotion or campaign; or
• engage in conduct that could damage SEAKER’s reputation.
5.2 SEAKER may monitor, limit, or remove Content that breaches these Terms or is otherwise objectionable, and may suspend or terminate access for violations.
6. License Grant & Restrictions
6.1 License — SEAKER grants you a limited, revocable, non-exclusive, non-transferable, non-assignable, personal license to use the App and Software for your own personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.
6.2 Restrictions — You shall not: (a) license, sublicense, sell, resell, transfer, distribute, or commercially exploit the App or Software; (b) modify or create derivative works; (c) frame or mirror the Software; (d) reverse engineer or access the Software to build a competing product or copy its features; (e) remove any proprietary notices; or (f) reproduce or distribute copyrighted material or trademarks without the owner’s consent.
7. Data Protection & Privacy
7.1 Privacy Policy — SEAKER collects and processes your Personal Data in accordance with Republic Act No. 10173 (Data Privacy Act of 2012), its Implementing Rules and Regulations, the issuances of the National Privacy Commission (NPC), and the SEAKER Privacy Policy. SEAKER is a registered Personal Information Controller (NPC Registration No. PIC-001-840-2025).
7.2 Your rights — Subject to applicable law, you have the right to be informed, and to access, correct, object to or restrict processing of, and request erasure or portability of your Personal Data. You may also lodge a complaint with the NPC. Requests may be made to the Data Protection Officer using the details in Section 14.
7.3 Data-sharing consents — Sharing of your data with your school, for welfare and emergency support, and with accredited Manning Agencies is governed by the Seafarer Data Sharing Consent Terms, where each consent is separate and may be withdrawn. Nothing in these Terms requires you to consent to data sharing as a condition of basic access, except where processing is necessary to provide a service you request or to comply with law.
7.4 No pay-for-privacy — SEAKER will not deny you access to core Platform features, or charge you a higher fee, solely because you decline optional marketing communications. You may opt out of marketing at any time.
8. Payments
8.1 Paid features
The Platform offers a range of paid features and purchases (“Paid Features”), including:
• Event tickets and passes — admission to maritime events, conferences, and seafarer welfare activities (e.g., MWMEC and similar events);
• Training course enrollments — Seaker Training (coming soon) — booking and payment for maritime training courses and STCW programs offered by accredited training institutions on the Platform;
• Learning materials and magazines — Seaker Media (coming soon) — digital and print maritime magazines, publications, and learning content distributed through the Platform;
• Accommodation bookings — Seaker Shelter (coming soon) — reservation of rooms, lodging, and short-term accommodation listed by Property Hosts on the Platform; and
• Other paid features — any other products, services, or content offered for purchase through the Platform as may be introduced from time to time.
Prices are displayed in the App at the time of purchase and are in Philippine Pesos (PHP) unless otherwise stated. SEAKER reserves the right to modify pricing at any time; changes take effect from the next transaction.
8.2 Payment method and processor
8.2.1 All payments for Paid Features are processed through PayMongo, an authorized third-party payment processor. By completing a purchase you agree to be bound by PayMongo’s terms and conditions and privacy policy in addition to these Terms. SEAKER is not responsible for the policies or performance of PayMongo.
8.2.2 You must use a valid credit card, debit card, or other payment method accepted by PayMongo that belongs to you, or for which you have the account owner’s express permission. You warrant that all payment details you provide are accurate, complete, and current.
8.3 Recurring payment authorization
Where you subscribe to a recurring plan, pass, or magazine subscription, you authorize PayMongo to automatically deduct the applicable fee from your card at the start of each billing cycle in accordance with the plan you selected. After each charge, SEAKER or the Merchant will notify you whether payment was successful. PayMongo shall not be held liable for the Merchant’s failure to notify you. The billing cycle and amount deducted are dependent on the instructions made by the Merchant to PayMongo. You may revoke recurring payment authorization by following the cancellation procedure in the App or by contacting us at dpo@seaker.ph at least five (5) business days before the next billing date.
8.4 Event tickets and passes
8.4.1 Tickets and passes purchased through the App are personal and non-transferable unless the event listing expressly states otherwise. Resale of tickets or passes without SEAKER’s prior written consent is prohibited.
8.4.2 SEAKER will deliver your ticket or pass digitally to your registered account or email address upon successful payment confirmation. You are responsible for presenting a valid ticket or pass at the event. SEAKER is not responsible for lost, stolen, or inaccessible tickets after delivery.
8.4.3 Event organizers may impose additional terms and conditions of entry. SEAKER is not responsible for the conduct, content, cancellation, or postponement of any event organized by a third party. Where an event is cancelled by the organizer without a rescheduled date, refunds will be processed in accordance with Section 8.8.
8.5 Training course enrollments — Seaker Training
Note: Seaker Training is a feature currently in development. The terms in this section will apply when the feature is made available to seafarers.
8.5.1 When you book a training course through Seaker Training, your enrollment details (name, contact information, booking reference, and payment confirmation) will be shared with the relevant Seaker Training Provider to confirm your registration and deliver the course. This data sharing is transactional and is separate from the School Visibility consent in the Seafarer Data Sharing Consent Terms.
8.5.2 Seaker Training Providers on the Platform are independent training centers. Each Seaker Training Provider may have its own attendance, assessment, and certification issuance policies displayed in their course listing. You are responsible for reviewing and complying with those policies at the time of booking.
8.5.3 Cancellation and refund eligibility for Seaker Training courses is subject to the provider’s cancellation policy as stated in the course listing. Where no policy is stated, the general refund policy in Section 8.8 applies. Cancellations made less than forty-eight (48) hours before the course start date may not be eligible for a refund.
8.5.4 SEAKER is not responsible for the quality, content, scheduling, or accreditation status of courses offered by Seaker Training Providers on the Platform. It is your responsibility to verify that a course meets your certification or STCW compliance requirements before enrolling.
8.6 Learning materials and magazines — Seaker Media
Note: Seaker Media is a feature currently in development. The terms in this section will apply when the feature is made available to seafarers.
8.6.1 Digital learning materials, publications, and magazines purchased through the Platform are delivered electronically to your registered account or email address upon successful payment. Physical publications are dispatched by the publisher and subject to the publisher’s delivery terms.
8.6.2 Digital content is non-refundable once accessed or downloaded, except where required by applicable consumer-protection law. If you have not yet accessed or downloaded the content, a refund request may be submitted within twenty-four (24) hours of purchase.
8.6.3 Magazine subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.
8.7 Accommodation bookings — Seaker Shelter
Note: Seaker Shelter is a feature currently in development. The terms in this section will apply when the feature is made available to seafarers.
8.7.1 When you book accommodation through the Platform, your booking and personal details will be shared with the Property Host to confirm and fulfill your reservation. The Property Host is responsible for the accommodation and its condition; SEAKER acts as the booking intermediary only.
8.7.2 Each accommodation listing displays the Property Host’s cancellation policy (e.g., free cancellation, non-refundable, partial refund). You agree to the applicable cancellation policy at the time of booking. SEAKER will process refunds in accordance with that policy.
8.7.3 SEAKER is not responsible for the accuracy of accommodation listings, the quality of the property, or disputes between you and the Property Host. Complaints regarding accommodation should be raised first with the Property Host and, if unresolved, with SEAKER at dpo@seaker.ph.
8.8 General refund policy
8.8.1 Subject to the category-specific rules in Sections 8.4 to 8.7, all purchases are final and non-refundable unless: (a) the service or product is cancelled or not delivered by the provider; (b) SEAKER determines at its discretion that a refund is warranted; or (c) applicable consumer-protection law requires a refund.
8.8.2 Where a refund is approved, it will be processed to the original payment method within seven (7) to fourteen (14) business days, subject to your card issuer’s processing times. SEAKER is not responsible for delays caused by your bank or card issuer.
8.8.3 To request a refund, contact us at dpo@seaker.ph with your order reference, the Paid Feature concerned, and the reason for your request.
8.9 Authorization holds
SEAKER or PayMongo may issue an authorization hold on your card to verify payment details before completing a transaction. An authorization hold is not an actual charge; it will be released if the transaction does not proceed.
8.10 Failed payments
If a payment fails, access to the relevant Paid Feature will not be granted or will be suspended until successful payment is received. SEAKER is not liable for any loss or inconvenience arising from a failed transaction due to issues with your card, bank, or internet connection.
8.11 Chargebacks and disputes
If you initiate a chargeback or payment dispute with your card issuer, SEAKER and PayMongo may provide transaction evidence to the card issuer. Chargeback fees or administrative costs arising from disputes determined to be unwarranted may be passed on to you. You agree to contact SEAKER first at dpo@seaker.ph to resolve payment disputes before initiating a chargeback.
8.12 Taxes
Prices displayed in the App may or may not include applicable taxes. Where required by law, applicable taxes (including VAT) will be shown separately at checkout. You are responsible for any taxes applicable to your purchases under the laws of your jurisdiction.
8.13 Fraud prevention
SEAKER may suspend or cancel any transaction it reasonably believes to be fraudulent, unauthorized, or in breach of these Terms, without prior notice. You agree to cooperate with any financial-crime or fraud screening required by law, and you are responsible for resolving disputes with your card issuer.
9. Intellectual Property
9.1 SEAKER and its licensors own all right, title, and interest, including all intellectual property rights, in and to the Platform, App, Software, and Service, and any feedback or suggestions you provide. These Terms do not transfer any ownership rights to you.
9.2 The SEAKER name, logo, and product names are trademarks of SEAKER or third parties; no right or license to use them is granted.
10. Third-Party Interactions
10.1 Any dealings with Platform Partners or other third parties through the Platform — including any terms, warranties, or representations — are solely between you and that third party. SEAKER has no responsibility or liability for such interactions.
10.2 The Platform may contain links to or content from third parties. SEAKER does not endorse and is not responsible for third-party sites, products, or services. Certain Platform Partners may require you to accept their own additional terms.
11. Disclaimer of Warranties
11.1 THE PLATFORM, APP, AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. SEAKER MAKES NO REPRESENTATION OR WARRANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY, OR COMPLETENESS OF THE SERVICE, AND DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11.2 SEAKER DOES NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THE SERVICE MAY BE SUBJECT TO LIMITATIONS AND DELAYS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS, FOR WHICH SEAKER IS NOT RESPONSIBLE.
12. Limitation of Liability
12.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SEAKER OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, OR ANY DEALINGS WITH PLATFORM PARTNERS OR OTHER THIRD PARTIES.
12.2 SEAKER’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO SEAKER, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; PROVIDED THAT THIS LIMITATION SHALL NOT APPLY TO LIABILITY ARISING FROM SEAKER’S WILLFUL MISCONDUCT, FRAUD, OR GROSS NEGLIGENCE.
12.3 The quality and safety of services provided by Platform Partners are solely the responsibility of those Partners. You acknowledge that you use such services at your own risk.
13. Indemnification
13.1 You agree to defend, indemnify, and hold harmless SEAKER, its affiliates, licensors, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use or misuse of the Platform; (b) your dealings with Platform Partners or other third parties; (c) your breach of these Terms or any applicable law; or (d) your violation of any rights of a third party.

15. Notices
15.1 SEAKER may give notice by a general notice on the App, by email to the address on record, or by written communication. Notice is deemed given one (1) hour after sending by email, or forty-eight (48) hours after mailing. You may give notice to SEAKER using the contact details in Section 14.
16. Termination
16.1 SEAKER may suspend or terminate your access immediately if you breach these Terms, engage in unlawful or fraudulent conduct, or where required to protect the Platform or its users.
16.2 You may stop using the Platform and close your account at any time. Sections that by their nature should survive termination — including Data Protection & Privacy, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law & Dispute Resolution — will survive.
17. Governing Law & Dispute Resolution
17.1 These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
17.2 Any dispute arising out of or relating to these Terms shall be finally resolved by arbitration seated in Manila, Philippines, conducted in English under the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI) or its successor. The arbitral award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
17.3 Notwithstanding the foregoing, SEAKER may seek interim or injunctive relief before the courts of Manila, Philippines, to protect its rights or prevent irreparable harm.
18. General
18.1 Assignment — You may not assign these Terms without SEAKER’s prior written consent. SEAKER may assign its rights without your consent.
18.2 Severability — If any provision is held invalid or unenforceable, it shall be struck and the remaining provisions shall remain in full force.
18.3 No Waiver — SEAKER’s failure to enforce any right is not a waiver of that right.
18.4 Entire Agreement — These Terms, together with the SEAKER Privacy Policy and the Seafarer Data Sharing Consent Terms, constitute the entire agreement between you and SEAKER regarding the Platform and supersede all prior agreements, including the Terms of Use last modified 1 July 2016.
18.5 Language — In the event of any conflict between the English and any translated version, the English version prevails.
